On February 27, 2025, the trial of Temirlan Ensebek, the author of the satirical Instagram page Qaznews24, began in the Almaly District Court of Almaty. This case has attracted widespread public and human rights attention as it raises concerns about freedom of speech and the persecution of satire in Kazakhstan.

Transfer of the Case and Denial of Bail Reduction

At the first hearing, Judge Serik Kenishev granted the prosecutor’s request to transfer the case to the Nauryzbay District Court, arguing that the alleged offense took place at Ensebek’s home, which is located in that district.

At the same time, the defense’s request to ease the pretrial detention was denied, meaning Temirlan Ensebek remains in custody, despite the arguments made by his lawyers.

What Led to His Arrest?

Temirlan Ensebek was arrested on January 17, 2025, on charges of inciting ethnic hatred (Article 174, Part 1 of the Criminal Code of Kazakhstan).

The reason for the case was a publication in his satirical page Qaznews24, which mentioned Russian TV host Tina Kandelaki and included the song “You, Russians”. The Kazakhstani authorities deemed this post potentially dangerous and contributing to interethnic tensions.

Why Is This Case Important?

1. Freedom of Speech Under Threat

The trial of a satirist highlights how vulnerable freedom of expression is in Kazakhstan. Satire has always been a powerful tool for social criticism, but now it can lead to imprisonment.

2. A Precedent for Other Bloggers and Journalists

Ensebek’s case could set a dangerous precedent, where any writer using satire or humor could face criminal charges.

3. Public Reaction

Kazakhstani and international human rights organizations are already raising concerns about pressure on satirists and journalists. A movement in support of Temirlan Ensebek is gaining momentum on social media and independent platforms.

What’s Next?

Following the case transfer to the Nauryzbay District Court, a new trial will take place. There is no confirmed timeline for a verdict, but given the seriousness of the charges, the process could be prolonged.

This case will serve as a litmus test for the state of freedom of speech in Kazakhstan. Keeping track of developments is crucial not only for those interested in politics but also for everyone who supports justice and the right to free expression.
